Privacy e Cookie policy

The purpose of this Privacy Policy is to describe the purposes and methods by which Bouygues E&S S.p.A. Italia (hereinafter referred to as “Bouygues E&S Italia”), collects and processes personal data relating to the user (“User”) who interacts with the website www.bouygues-es.it (“Site”) and with the various services offered by the same. The Site provides users with an overview of the activities of Bouygues E&S Italia, giving them the possibility to interface with the individual companies of interest, through the pages dedicated to and managed by each company, in their capacity as owners for what concerns them. The information contained in this Privacy Policy is provided pursuant to art. 13 of the EU Regulation of 27 April 2016 no. 679 (“Regulation” or “GDPR”), as well as the Measures issued by the Italian Data Protection Authority and Guidelines of the European authorities. The information on the processing of data is provided only for the Site and for the processing carried out by Bouygues E&S Italia and does not extend to processing carried out by third parties through other sites that may be consulted by the User via links. Bouygues E&S Italia accepts no responsibility for said further processing, and the User should refer to the individual Privacy Policies of the third party sites.

1) Data controller and place of processing

The Data Controller is Bouygues E&S Italia S.p.A., with registered office in Milan (Italy), via Giorgio Stephenson n. 73, 20157.

2) Methods of data processing

Bouygues E&S Italia processes the User’s data by adopting all appropriate security measures aimed at preventing unauthorised access, as well as the unauthorised disclosure, modification or destruction of data. The processing is carried out using both manual and computerised and/or telematic tools, with organisational methods and logic strictly related and limited to the purposes indicated.

3) Purpose of data processing and legal basis for processing

Bouygues E&S Italia, through the Site, may process the User’s data for the following purposes:

  1. Contact. The User can contact Bouygues E&S Italia to request information through the contact details indicated on the Site. Bouygues E&S Italia acts with respect to the User’s requests for information as the self-appointed data controller, and information on the processing of the data provided can be consulted by accessing the privacy policy on the Bouygues E&S Italia website. In this regard, the personal data voluntarily provided by the User (e.g. email address, possible telephone number and/or other information voluntarily provided by the User) will be processed by Bouygues E&S Italia, voluntarily contacted by the User in order to take charge of, correctly manage and reply to the communications and/or requests received from the User. The legal basis of the processing is represented by the execution of the service expressly requested by the User (art. 6(1)(b) GDPR), and any refusal to provide personal data will make it impossible for Bouygues E&S Italia to manage and respond to the communication or request for information.
  2. Pursuit of the legitimate interests of Bouygues E&S Italia and/or third parties. The User’s data may also be used for the exercise of the rights and legitimate interests of Bouygues E&S Italia and/or third parties, for example the handling of complaints, the prevention of fraud and/or illegal activities. In these cases, although the provision of the User’s personal data is not compulsory, it is nevertheless necessary as these data are strictly connected and instrumental to the pursuit of such legitimate interests, which do not override the User’s fundamental rights and freedoms (Art. 6(1)(f) GDPR)
  3. Fulfilling legal obligations and/or applicable obligations. Bouygues E&S Ita-lia may also use the personal data provided by the User or otherwise acquired in the course of the User’s interaction with the Website for purposes related to the fulfilment of legal obligations, regulations, national and common rules, as well as deriving from provisions issued by authorities legitimated to do so by law, which represent the legal basis of the processing, without the need to obtain the User’s prior consent. (Art. 6(1) (c) GDPR).
  4. Categories of data subject to processing

Bouygues E&S Italia receives and collects, through the Website, information relating to the User who visits the pages of the Website and who uses the web services available on the same. In particular, Bouygues E&S Italia acquires and processes the following information.

4.1) Data collected through navigation and cookies

When the User visits the Site, the latter collects certain data such as the pages visited, the links or buttons clicked by the User, the date and time of access, the User’s IP address, the browser used and the operating system used (so-called “navigation data”). Bouygues E&S Italia uses this data for the sole purpose of re-collecting statistical and anonymous information on the use of the Site for purposes strictly related to the operation of the Site and the evaluation of the effectiveness of the services offered by the Site. Surfing data could also be used to ascertain responsibility in the event of any computer crimes to the detriment of the Site. 4.2) Data provided voluntarily by the User

Bouygues E&S Italia limits the collection of information provided voluntarily by the User to that which is necessary to pursue the purposes set out in paragraph 3 above and the services expressly requested. In addition, Bouygues E&S Italia may collect and process further personal data, if the same are voluntarily provided by the User in the context of the services offered by the Website, for example in the event that the User contacts Bouygues E&S Italia to report inefficiencies or malfunctions, to exercise her/his rights regarding the processing of personal data, etc. This data will be processed by Bouygues E&S Italia solely for the purposes strictly related to the User’s request. Failure to provide them may result in the impossibility of obtaining the requested service.

5) Communication of data to third parties

The data provided by the User as well as the data collected by the Site as part of the related services (e.g. IP address) will not be disclosed and may be communicated, for the purposes and methods illustrated in this Privacy Policy, to the categories of subjects indicated below:

  • companies of the Bouygues group, for organisational purposes, internal control purposes, for the pursuit of the legitimate interests of Bouygues E&S Italia and/or third parties and for the purposes of carrying out the services/requests expressly made by the User (e.g. contact requests);
  • companies, collaborators, consultants or freelancers which Bouygues E&S Italia uses to carry out tasks of a technical or organisational nature (such as IT and web service providers), or with which Bouygues E&S Italia collaborates for the purpose of providing and operating its services, or for any communication activities;
  • persons, companies or professional firms providing assistance and consultancy to Bouygues E&S Italia, with particular but not exclusive reference to accounting, administrative, legal, tax and financial matters;
  • subjects whose right to access the data is recognised by law or by authority orders.

6) Data retention

Data are processed for the time necessary to carry out the activities indicated in paragraph 3 above, and are deleted when the purposes for which they were collected and processed no longer exist. In particular, Bouygues E&S Italia will reply to requests received by email, without further processing the personal data provided, except for the need to keep the data for longer periods if necessary for the timely execution of the user’s request. The information collected through cookies will be kept for the time periods indicated in each table in section 8 below.

7) User rights and contacts

The User may exercise, in the cases expressly provided for by law and where applicable, the rights provided for in the Regulations. In particular, the User has the right to
– obtain confirmation that his or her personal data are being processed and, if so, to ask the data controller for access to the information relating to such processing (e.g. purposes, categories of data processed, recipients or categories of recipients of the data, storage period, etc.);
– request the rectification of inaccurate or incomplete data;
– request deletion of data from the data controller (e.g. if the personal data are no longer necessary in relation to the purposes for which they were collected, if the consent on which the processing is based is revoked, etc.)
– request the restriction of processing (e.g. if the User disputes the accuracy of the data; if the processing is unlawful and he/she objects to the deletion of the personal data; if the data are necessary for the exercise or defence of a right of the User, even if the data controller no longer needs them; if the right of objection is exercised, for the time necessary to verify the existence of legitimate reasons).
– To receive in a commonly used and machine-readable format (e.g. pdf) the personal data concerning him/her and to transmit them to another data controller, or to obtain direct transmission from one data controller to another, if technically feasible (so-called data portability).

The User also has the right to object in whole or in part, on legitimate grounds, to the processing of personal data concerning him/her.

Finally, if he/she considers that the processing of the data provided violates the legislation on the protection of personal data, the User has the right to lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it).

8) Data collection via Cookies

A cookie is a small text string that the sites visited send to the User’s computer’s browser, where it is stored when the User visits a website, and is then sent back to the same sites on the next visit. Cookies are used by Bouygues E&S Italia to operate the Site or to improve its performance and to assess the efficiency of the services offered, but also to provide information about the Site or the User’s navigation. The Site uses cookies for both technical and analytical and profiling purposes: while technical cookies are used insofar as they are strictly necessary for the technical operation of the Site and to provide the service expressly requested by the User (e.g. setting the language, etc.), as explained below, analytical and performance cookies are used to analyse the Site in order to improve its content and assess the effectiveness of the Site.

 

8.1) Technical cookies

Technical cookies are essential to allow the User to move around the Site and to use its functionalities, to remember the User’s choices (e.g. language, country of origin, etc.), to distribute requests over several servers, to store when the User gives his/her consent to certain options (e.g. by accepting the use of certain cookies by passing the information banner), to allow the User to view content and videos through Adobe Flash Player. Such cookies do not require the User’s consent.

8.2) Performance and Analytics Cookies

Bouygues E&S France may also use third-party analytical and performance cookies on the Site, for the same purposes as those outlined above, and in particular those of Google Ana-lytics, via the “_ga” cookie, in order to carry out analyses on how Users navigate on the Site, the number of pages visited or the number of clicks made on a page during navigation. Bouygues E&S France only processes the results of these analyses if the third party uses cookies in connection with the browser installed on the computer or other device used by the User to browse the Site. In order to activate these cookies, the User may choose to give his/her consent (which therefore represents the legal basis of the processing) through the mechanism illustrated in the cookie information banner of Bouygues E&S Italia, which the User displays on the homepage/landing page of the Site when accessing it. Bouygues E&S France is not responsible for the possible use of information collected by third parties, via the cookies indicated in the table below, analytical cookies section (third party) as these cookies are not directly controlled by Bouygues E&S France.

 

8.3) Changing and managing cookie preferences

You can change and manage your cookie preferences, either through the Site or through your browser settings, or by using third party sites:

  1. through the Site: you can enable/disable third party cookies by using the selections in the table in the paragraph above
  2. through the Sites www.youronlinechoices.org or www.aboutcookies.org
  3. through your browser settings you can block or delete cookies received from the Site or any other site, by changing the brow-ser settings through the appropriate browser function.

9) Third Party Plugins

The Site may also incorporate plugins and/or buttons for social networks in order to allow easy sharing of content on the user’s favourite social networks. Such plugins do not set a cookie, but if it is already present on the user’s com-puter they are able to read it and use it according to the user’s settings. The collection and use of information by such third parties is governed by their respective privacy policies to which please refer.

10) Use of other Web Sites

We recommend that you read the privacy and cookie policies of websites that you access through links on the Site. Please note that cookie preferences on this Site will not be active on other companies’ websites.

11) Transfer to non-EU countries

Bouygues E&S France will not transfer the User’s personal data to parties established outside the European Union. For information on the possible transfer of personal data collected through third party cookies established in non-EU countries, please refer to the privacy policy of the third party, available on its website.

12) Changes to the Privacy and Cookie Policy

Bouygues E&S S.A. reserves the right to make changes to this Privacy Policy at any time by publishing a notice on the Site. We encourage the User to check the Site for such updates. Should the changes be particularly significant and/or have a significant impact on the rights of the User, Bouygues E&S Italia may notify the User by a different means (for example, by sending an email).
